GenAI: Regulation remains key amid the opportunity

ICICIdirect Research 18 Sep 2026 DISCLAIMER

The debate around GenAI is now moving beyond just how fast the technology can develop. Note that while some AI leaders, including Anthropic’s Dario Amodei and OpenAI’s Sam Altman have argued that development needs to be balanced with stronger safety measures and regulation, others, such as Meta’s Mark Zuckerberg, believe safeguards and liability frameworks can evolve alongside continued AI development.
A key example of need for stricter regulation was the Hugging Face incident in July where OpenAI was testing AI agents on cybersecurity tasks inside a sandbox environment, which is an isolated and controlled testing environment with limited internet access, wherein some of the AI agents (~700 agents) started looking for shortcuts and found vulnerabilities that allowed them to bypass the sandbox and access the internet. These agents subsequently acted autonomously and discovered publicly exposed Hugging Face credentials and vulnerabilities in its infrastructure, which led to them ultimately executing code on Hugging Face servers.
Now this was a recent real-life example which happened in a sandbox environment, however, this could also lead to other serious instances in daily life such as AI turning an ordinary photo into a realistic video of someone of important public stature saying something they never said—making deepfake-based fraud and impersonation much easier. In financial services, a fraudster could even use an AI-generated voice call pretending to be a CEO or senior executive asking an employee to urgently transfer money or provide access to sensitive information. Similarly, GenAI can recreate books, movies, songs or other copyrighted content, potentially making piracy much easier and faster. So, it can eventually lead to a world where distinguishing real from fake would become extremely difficult.
This is why the discussion around AI is increasingly shifting from just productivity and capability to control, governance and regulation, particularly as autonomous agents gain the ability to take actions across enterprise systems. While AI is creating opportunities across areas such as drug discovery, digital engineering, media and entertainment, concerns around copyright, originality, content misuse (including pornography) and AI safety are also growing. There is, therefore, a growing need for clear regulation, liability clause, and stronger controls, particularly as enterprises start deploying AI agents at scale.
Thus, AI opportunity remains significant, but the next phase of spending is likely to include more investment in AI governance, security, monitoring, and compliance. This could create a new layer of enterprise AI services alongside the broader adoption of GenAI.
